Terms of Service

The agreement between you and Orty.

These terms are written in plain language on purpose. By buying or using Orty, you agree to them. If anything is unclear, email us before you buy.

1. The parties

"Orty," "we," and "us" refer to Orty, the indie software studio that makes Orty. "You" refers to the person who purchases and uses the software. Orty is solo-founded and operated.

2. License grant

A Free or Pro subscription grants you a single-user, non-transferable, non-exclusive license to access the Orty web app for your own personal or business use. "Single-user" means one person — you (one Whop account). You may access the web app from any of your own devices, but you may not share your Whop credentials or your subscription with other people.

3. Permitted use

You may:

  • Access Orty at getorty.work on any device (Mac, Windows, mobile) via Whop login.
  • Use the software to rate creators, draft cold emails, and manage your outreach CRM.
  • Make reasonable backups of your CRM workspace (one-click zip export) and store copies for your own use.
  • Use your own API keys for the providers you enable in Settings (Google Gemini for rating and audits; Groq, OpenRouter, Cerebras, Together, Mistral, or OpenAI for chat), in accordance with those providers' own terms of service.

You are responsible for complying with all applicable laws in your use of the software, including email regulations such as CAN-SPAM, GDPR, and CASL. The app helps with CAN-SPAM by appending a compliance footer to generated emails, but compliance is ultimately your responsibility.

4. Prohibited use

You may not:

  • Redistribute, resell, sub-license, lease, or rent the software to anyone else.
  • Share your copy with other people. Each person who uses the software needs their own purchase.
  • Reverse engineer, decompile, or disassemble the software, except to the extent that applicable law explicitly prohibits this restriction.
  • Use the software to send unsolicited email in violation of applicable law, or to generate content that is unlawful, defamatory, or infringes the rights of others.
  • Remove, alter, or obscure any proprietary notices in the software.

5. Payment and delivery

Orty is sold as a subscription: Free tier (no charge, 3 ratings + 3 Co-Pilot messages per Whop account per day) or Pro at 19.99 USD per month, billed through Whop. Checkout, card storage, PayPal, and crypto are handled entirely by Whop (Whop product prod_wBSzJmZU1f1sV). Orty never sees or stores your card details. Access is delivered electronically at getorty.work (proxied to Google Cloud Run, europe-west1) — login with your Whop account via OAuth (PKCE S256). Pro is verified automatically at login and on each gated request via a signed Whop webhook (/webhooks/whop, HMAC-SHA256) that flips is_pro live on subscription events.

The legacy Windows installer (OrtySetup v1.20.2) is sunset for new sales — existing beta buyers retain their $29 one-time license through October 1, 2026. After that date the desktop app is no longer supported and your Pro entitlements live entirely on the web product.

6. Refund policy

Orty comes with a 7-day money-back guarantee on every new Pro subscription — no questions asked. Cancel anytime via your Whop dashboard; the current billing period remains accessible until it ends. Refunds are processed by Whop; reach out via hello@getorty.work and we'll start one on your behalf.

Refunds will not be issued for AI-drafted content you are personally unsatisfied with, since output quality depends on your own API key usage and the information you provide about your business. We can't return money for a working product you simply don't like the output of.

7. Disclaimer of warranty

The software is provided "as is" and "as available," without warranties of any kind, whether express or implied. Orty does not warrant that the software will be error-free, uninterrupted, or that it will meet your specific requirements.

Because the software relies on third-party AI providers (Orty's managed engine, or a provider you bring your own key to on the $5 Signal plan), Orty cannot guarantee the availability, accuracy, or cost of those services. Any reliance on AI-generated content (ratings, email drafts, audits) is at your own risk — always review what the model produces before acting on it.

To the extent permitted by applicable law, all implied warranties, including merchantability and fitness for a particular purpose, are disclaimed.

8. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Orty be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the software — even if advised of the possibility of such damages.

Orty's total liability for any claim arising out of or relating to the software is limited to the amount you paid for the software in the 12 months preceding the claim (i.e., 19.99 USD × months subscribed, or $0 for Free-tier users). Your CRM is synced per Whop account (Supabase + local cache); Orty is not liable for its loss. Export your workspace as a zip regularly as a backup.

9. Third-party services

Orty integrates with the AI providers you enable in Settings — Google Gemini for rating and audits, and Groq, OpenRouter, Cerebras, Together, Mistral, or OpenAI for chat drafting — each accessed with your own API keys. Your use of those services is governed by their respective terms of service and privacy policies. Orty is not responsible for the behavior, availability, pricing, or data practices of those providers. The software also uses yt-dlp to download audio for the Long Form feature; yt-dlp is licensed under the Unlicense.

Infrastructure and operations sub-processors: Google Cloud Run (hosting, europe-west1) and Supabase (per-account database with row-level security) store and serve your workspace; Whop processes checkout and verifies subscriptions; PostHog (server-side, occurrence-only product analytics — no lead content) and Sentry (errors-only crash reporting with personal data scrubbed) keep the app measured and stable. None of these receive your API keys, prompts, screenshots, or drafts.

10. Governing law

These Terms are governed by the laws of the jurisdiction where Orty is operated, without regard to its conflict-of-laws principles. Disputes will first be attempted in good faith via email to hello@getorty.work for 30 days before either party files in a court of competent jurisdiction.

11. Changes to these terms

We may update these terms from time to time. If we do, the "last updated" date above will change, and material changes will be communicated to buyers by email. Continued use of the software after a change constitutes acceptance of the updated terms.
